Preamble

The site " beautifuldaycollection.com " is the property of the company Beautiful Day in its entirety, including all the rights in relation to its contents in intellectual, industrial and artistic property. Any reproduction, even partial, is systematically subjected to the written authorization of the company Beautiful Day.

The general conditions of sales which follow describe the contractual relation between the BEAUTIFUL DAY limited company, RCS Paris 502 210 883 00026, head office: 33 rue des Trois Frères, 75018 PARIS, representative of the shop on-line www.beautifuldaycollection.com, this later called "Beautiful Day", and on the other hand, the person making a purchase through this site, this later called " the customer ".

1. Acceptance of the present general conditions of sale
The relations between the Beautiful Day and the customer will be exclusively governed by the present general conditions of sale which they accept without reserve. 
Any condition of law absent of the present will apply according to rules and manners current in the field of the remote sale  french companies.

The confirmation of  customer's order on the site "www.beautifuldaycollection.com", by clicking the button " to confirm my order " and in the compartment " I read and accepted the general conditions of sales " is worth acceptance in their entirety present general conditions of sales which will be executed and interpretated according to the French law.

2. Order
The customer has to have the legal capacity allowing him to make an order on the site. The click  "validation" of the customer having filled the order form establishes the confirmation of the order of the customer and have the same value as a handwritten signature.

The informations given by the customer during the taking of order involve customer's responsability. Any error can entail the cancellation of the order or the impossibility of delivery without involving the reponsability of Beautiful Day.

 Beautiful Day is habilited to not confirm an order, notably for availability reason. In that case, Beautiful Day informs the customer by telephone or e-mail to propose him a new delay or the cancellation of his order. Beautiful Day will proceed then to the refund of the customer by its re-credit of the bank card at the latest 20 days from the payment of the sums.

3. Geographical area 
It corresponds to the supply area of " Colissimo Expert " carrier service.

The service proposed by the www.beautifuldaycollection.com site extends in the following geographical zones: 

France and Corsica, french overseas departement, the whole European Union, Andorra, Liechtenstein, Monaco, Switzerland, Norway, Iceland, Turkey, Russia. 
South Africa, Cameroon, Ivory Coast, Senegal, Morocco, Egypt, Algeria, Lebanon, Saudi Arabia, United Arab Emirates, Israêl, Koweît, Jordan.

Japan, China, Hong-Kong, Thaïlande, Taïwan, Indonésia, Singapore, South Korea.

Canada, United States, Bahamas, Mexico, Venezuela, Brazil, Argentina, Chile, Australia, New Zealand.

4. Products
The photos of products appearing on the site are not contractual. In spite of the care brought by Beautiful Day to the representation and to the description of products, an error or a bad interpretation does not involve its responsibility.

5. Price
The prices are expressed in Euro inclusive of all taxes current in France. They do not include the costs of shipping and delivery which are notified to the customer before confirmation  of the order.      

A delivery within the European Union do not entails other tax collection. For a delivery out of European Union, the customer will pay the customs duties and other taxes according to the regulations in force in the country of import.

An invoice established by Beautiful Day will be sent for every order to the billing address given by the customer.

6. Payment
The price charged to the customer is the price indicated during the confirmation of order; it is payable immediatly, by bank card, by bank transfer, or by check (only for France).

The payment by bank card can be made with the network CB, VISA, on-line MASTERCARD, AMERICAN EXPRESS. Le payment is made in the secure environment set up by the CREDIT MUTUEL (Cybermut). The order validated by the customer is considered as actual only when the payment center gives its agreement. In case of refusal, the order is cancelled and the customer advised by e-mail.

In case of a payment by credit transfer or check, the order validated by the customer is considered as actual only when the amount of the payment is credited  on Beautiful Day's bank account.

Property reserve: the ordered products remain the whole property of Beautiful Day up to the definitive and complete payment of their price according to the terms of the law N° 80 335 of May 12th, 1980.

7. Delivery
Products are delivered to the delivery address indicated by the customer during the order. The information given by the customer during order involve his responsability, and an error entailing an impossibility of delivery could not be the responsibility of Beautiful Day. A new delivery will be charged in this case to the customer according to its real cost.

The modalities of delivery are described in the page " Delivery and Return ", the delays depending of the destination of delivery in the geographical zone mentioned in the article 3 of the present Terms & Conditions.

8. Faculty of retraction
According to the article L.121-16 of the code of the consumption, the customer has a working period of seven days from the reception of his product to return it to the Beautiful Day, for exchange or refund without penalty except the expenses for return and if necessary new shipping. The returned product will have to be in its original state and packing, including accessories and notes.

Beautiful Day proceeds then to the refund of the sum paid by the customer in 30 days which follow the reception of the product.

9.Warranty, responsibility.

Products benefit from the legal guarantee against the latent defects (articles L211-1 of the code of the consumption, articles 1641 in 1648 of the civil code).
In spite of the care brought to the manufacturing and to the packaging of its products, if a product was defective or presents a defect of conformity, Beautiful day exchange it (according to the available stock), or repays  it at the latest in 30 days after the return of the product. For that purpose, the customer has to inform Beautiful Day  by mail  of the precise motives for this return at the latestin 7 days which follow reception of the product..

However, the responsibility of Beautiful Day is limited to the value of the product  at the date of its sale to the customer.

The proposed products are in accordance with the legislation current in France and in the European Union, and the responsibility of Beautiful Day would not be involved because of the regulatory and legislative measures current in the country of reception.

A delay in delivery  due to  a  stock shortage to one of his suppliers does not start the responsibility of Beautiful Day which has the bond to inform his customer of this delay.

Beautiful Day cannot be considered responsible for the non-fulfillment of the contract in case of : blocking of the internet networks, the breakdowns computing, blockings of the means of transportation or supply, nor consequential damage which could arise because of the purchase of products.

10. Right of access and rectification.

According to the law N 78-17 of January 6th, 1978, the customer dipose of a right of access, rectification and deletion of the data concerning him. For that purpose, he just has to state it by e-mail or by simple mail at the following address: BEAUTIFUL DAY, 33 rue des Trois Frères, 75018 PARIS.
The declaration number of the site " www.beautifuldaycollection.com " to the CNIL (National Commission of the Computing and the Liberties) is 1318061.
